I found the recent thread started by a query by Mike Driscoll concerning spam revealing (22554), and I'd like to expand the discussion a bit. Basically, I would like to hear if anyone knows of a truly rigorous definition of spam.

Obviously, the categories of porn and fraudulent marketing fall outside acceptable limits, and hopefully there will be adaptations of existing legal means to deal with those. Let's leave this out of the discussion.

But there is a large gray area for other types of commercial messages. I do not accept the starting point that any commercial messaging must be invited. This places an unreasonable burden on both the consumer and the marketer. The only justiication for that argument is the cost to the receiver. Basically, either the online environment is open to all, or it isn't.

I cannot think of, and haven't found, a spam definition based on either source or content that holds up under real examination. Have you? Is there another factor that could be used?
